Frequently asked questions about Prevention of Workplace Sexual Harassment

★

What is the difference between sexual harassment and sex-based harassment?

Sexual harassment involves unwanted conduct of a sexual nature [verbal or physical]. Sex based harassment is discriminatory behavior carried out because of a person's sex [for example, for being pregnant or for being a woman/man in a particular position] with the aim of violating their dignity.

Is it mandatory to have a harassment protocol in the company?

Yes. Under the Equality Law, all companies, regardless of size, must promote working conditions that prevent harassment and put in place specific procedures [protocols] for its prevention and for addressing complaints.

What is quid pro quo harassment?

It is sexual blackmail. It occurs when a superior conditions a workplace decision [a promotion, a raise, or continued employment] on the victim accepting sexual demands.

Are complaints confidential?

Absolutely. The protocol must guarantee the complete confidentiality of the data of the victim and the accused, as well as of the witnesses, to protect the privacy and dignity of all persons involved during the investigation.

What should I do if I witness harassment?

The course teaches you how to act. Ideally, you should report it to the Investigating Committee or to the HR manager according to the company's protocol. Looking the other way can make you complicit in the situation and perpetuate the hostile environment.
