What is the legal difference between domestic violence and gender-based violence?

  • Gender-based violence is that exercised by a man against a woman with whom he has or has had an intimate relationship, based on a situation of inequality.

What is vicarious violence and how is it detected?

  • Vicarious violence is a form of gender-based violence in which the perpetrator uses sons and daughters as an instrument to inflict the greatest possible pain on the mother.

    It is detected through threats concerning the minors [[I'll take them from you], [you will never see them again]] or through using the children to control or insult the mother. It is considered one of the cruelest forms of violence.

How does an Order of Protection work?

  • The Protection Order is a court order that unifies criminal and civil measures.

    Criminally, it can impose pretrial detention or a ban on approaching or contacting. Civilly, it regulates the use of the family home, custody of minors, and child support. It is activated when there is an objective risk to the life or bodily integrity of the victim.

Do professionals have an obligation to report if they detect abuse?

  • Yes. According to the Law of Criminal Procedure, any professional [doctor, teacher, social worker] who, by reason of their position, becomes aware of a public crime such as abuse, is obliged to report it.
