Frequently asked questions about Domestic and Gender-Based Violence

What is the legal difference between domestic violence and gender-based violence?

  • Gender based violence is that which is perpetrated by a man against a woman with whom he has or has had an intimate relationship, based on a situation of inequality.

Domestic violence occurs within the family unit but does not fit the previous definition [e.g.: violence by children against parents, between siblings, or from a woman to a man]. Criminal proceedings and the competent courts are different.

What does the VioGén system consist of?

  • The VioGén System is a program of the Ministry of the Interior that consolidates information on victims of gender based violence.

It allows law enforcement to carry out a Police Risk Assessment [VPR] to determine the level of danger [Not observed, Low, Medium, High, Extreme] and automatically assign the police protection measures necessary for the victim.

What is vicarious violence and how is it detected?

  • Vicarious violence is a form of gender based violence in which the perpetrator uses sons and daughters as a means to cause the greatest pain to the mother.

It is detected through threats concerning the minors [[I'll take them away from you], [you will never see them again]] or through using the children to control or insult the mother. It is considered one of the most cruel forms of violence.

How does a protective order work?

  • The Protection Order is a court ruling that combines criminal and civil measures.

Criminally, it may impose pretrial detention or a ban on approaching and communicating. Civilly, it regulates the use of the family home, the custody of minors, and child support. It is activated when there is an objective risk to the life or bodily integrity of the victim.

Are professionals required to report when they detect abuse?

  • Yes. According to the Criminal Procedure Act, any professional [physician, teacher, social worker] who, by virtue of their position, becomes aware of a public offense such as abuse is required to report it.

The course explains how to issue the injury report or the social report and forward it to the competent judicial authority without jeopardizing the victim's immediate safety.
