Article 44 determines the measures to be taken nationally for the labeling of unpackaged products.

Paragraph 1: For foods sold to final consumers and mass caterers without packaging, or foods which at the request of the customer are packaged in the same establishment, or which are packaged for immediate sale, the following is established:

  • The references or indications for labelling specified in Article 9.2 (c) shall be mandatory.
  • Unless member states take national measures requiring some, all or part of them, the remaining indications listed in Articles 9 and 10 shall not be compulsory on the labelling of products.

For allergen labeling, Article 44.1 (a) is very important since it determines that information on allergenic substances contained in unpackaged foods must be indicated.
